DirectTrack Competitor Sues to Force Usage of DirectTrack

Pttsburgh, PA – May 17, 2005 - Direct Response Technologies, Inc., a leading provider of online media and technology solutions, announces a lawsuit filed by customer PrimaryAds, a client utilizing DirectTrack® (Direct Response's proprietary affiliate and ad serving technology) as the back bone for their network. PrimaryAds is a wholly owned subsidiary of Think Partnership, Inc . (AMEX – THK ) a direct competitor of Direct Response Technologies, Inc.

In a strange turn of events - PrimaryAds, a subsidiary of Think Partnership, a firm that utilizes DirectTrack® to power their network and also owns Kowabunga! Technologies, Inc. which is a direct competitor to DirectTrack, has filed suit in the Court of Common Pleas of Allegheny County, Pennsylvania, today. Instead of PrimaryAds using Kowabunga! Technologies' My Affiliate Program (MYAP) technology (which is owned by the same parent company) to power their network, PrimaryAds has filed suit against Direct Response Technologies to force Direct Response Technologies to continue to power PrimaryAds network using the DirectTrack platform. Direct Response Technologies had asked PrimaryAds to transition off of their DirectTrack platform in April providing ample time for transition, because of the obvious confidentiality issues their ownership of Kowabunga! raises. However PrimaryAds refuses to leave, stating in their lawsuit, irreparable harm that will destroy their business if they had to leave the DirectTrack platform.

“Today was an odd day for us”, Jason Wolfe President and CEO of Direct Response Technologies, Inc. states, the “Think Partnership purchased our leading technology competitor Kowabunga! Technologies, Inc. in March 2005, whom offer the My Affiliate Program application (MYAP), and instead of moving PrimaryAds over to MYAP to power their network, they have chosen to sue Direct Response Technologies, Inc. to force us to continue to serve PrimaryAds with our DirectTrack ® Network platform. We find it quite flattering that DirectTrack is preferred over MYAP, even by the owners of their own parent company Think Partnership, however we find it troubling that PrimaryAds and Think Partnership (THK) have decided to take legal action in what seems a competitive maneuver to run up legal bills and cause a distraction to our company instead of just moving on” Wolfe continues.

 DirectTrackTM Version 6.0


This Tuesday March 29th DirectTrackTM will release Version 6.0.  The upgrade will be free for all current clients.  This version has been in the works for over 4 months.  Some of the major updates in 6.0 include:
  • Improved user interface and support documentation
  • New release of CrossPublication - the industries ONLY Network of Networks that enables ALL DirectTrackTM users to pass offers between their systems with the touch of a button
  • New creative types including Contextual Ads and Email Specific Creatives
  • Impression tracking on all HTML ads
  • Improved Creative Optimization functions giving clients the ability to automatically optimize their ads based on conversion rates, geo-targeting, and time of day
DirectTrackTM currently powers over 90 Affiliate/CPA Networks and hundreds of Merchant level clients.  Over 400 campaign offers are currently passed between DirectTrackTM clients through  CrossPublication
